What is it?<\/strong><\/p>\n

 <\/p>\n

Since the 25th<\/sup> of May 2018 the General Data Protection Regulation (\u201cGDPR\u201d), governs the processing and transfer of personal data of natural persons.<\/p>\n

Does it apply to me?<\/strong><\/p>\n

It applies to undertakings (including natural and legal entities e.g. companies) which:<\/p>\n

    \n
  1. process personal data as part of the activities of one of their branches established in the European Area\u00a0 (\u201cEEA\u201d), irrespective of where the processing takes place; or<\/li>\n
  2. \u00a0offer goods\/services to, or monitor the behavior of individuals in the EEA despite being outside the EEA (Art. 3 GDPR).<\/li>\n<\/ol>\n

     <\/p>\n

    Why is it important?<\/strong><\/strong><\/p>\n

      \n
    1. \u00a0The burden of proof has shifted from the supervisory authority to the undertakings, which are now obliged not only\u00a0to comply but to demonstrate<\/em> compliance with the GDPR.<\/li>\n
    2. Penalties of up to \u20ac20 million or 4% of the business\u2019s total annual worldwide turnover can be imposed. So far\u00a0in Cyprus, the imposed fines range from \u20ac400 to \u20ac1000.<\/li>\n
    3. As of September 2018, regular inspections are carried out by the Commissioner to ensure compliance.<\/li>\n<\/ol>\n

       <\/p>\n

      What should you do? <\/strong><\/p>\n

      Inter alia:<\/p>\n

        \n
      1. provide to individuals the information required by the GDPR through e,g, a Privacy Policy<\/u><\/strong> (Art. 13 GDPR);<\/li>\n
      2. \u00a0complete the processing record recommended by the Data Commissioner in Cyprus (Art. 30);<\/li>\n
      3. \u00a0have your consent forms<\/u><\/strong> ready to be used (Art. 7 GDPR);<\/li>\n
      4. \u00a0make sure that, proportionally to your size and types of personal data processed, you have implemented\u00a0appropriate\u00a0technical and organisational measures to protect the personal data (Art. 32 GDPR);<\/li>\n
      5. amend or add to the contracts<\/u><\/strong> with your employees, suppliers, service providers and associates to meet\u00a0the\u00a0\u00a0 GDPR confidentiality and data security requirements (Art. 28 GDPR).<\/li>\n<\/ol>\n
